Website Terms of Use
These terms govern use of the public Pulse Governance website, public resources, and interactive website experiences. Separate written agreements govern paid engagements, product access, confidential evaluations, and other contracted services.
Acceptance and scope
Use the site as information, not as a substitute for accountable professional judgment.
By accessing or using the public website, you agree to these terms. If you do not agree, do not use the website. If you enter into a separate written agreement with Pulse by Fierce Inc., Fierce Inc., or another identified contracting entity, that agreement controls the contracted service to the extent it conflicts with these website terms.
What the website is and is not
Public content explains a method and capability. It does not create a professional conclusion for your organization.
Informational content
Website content, examples, articles, framework descriptions, illustrations, calculators, interactive tools, and demonstrations are provided for general informational and evaluation purposes.
No legal or regulatory advice
Nothing on the public website is legal advice, a legal opinion, regulatory advice, investment advice, insurance advice, employment advice, or a substitute for advice from an appropriately qualified professional.
No automatic audit or certification conclusion
Use of the website does not create an audit, examination, attestation, certification, accreditation, SOC report, regulatory finding, or assurance opinion. Formal conclusions require the applicable scope, procedures, evidence, engagement terms, and authorized evaluator.
Illustrative and synthetic examples
Demonstration screens, sample reports, scenarios, example transactions, and sample outputs may be fictional or synthetic. They illustrate the method and do not represent a conclusion about a real organization unless expressly identified in a separate authorized engagement.
Pulse reports and professional work
A practitioner-signed Pulse report is a scoped deliverable, not a blanket certification.
When Pulse performs defined work under an engagement, a practitioner-signed Execution Integrity Report or other report may state what the defined procedures and evaluated evidence supported within the stated scope and limitations. Unless a separate engagement expressly provides otherwise, a Pulse report is not an independent CPA audit opinion, SOC attestation report, certification, or regulator-issued conclusion.
A CPA, auditor, Internal Audit function, regulator, examiner, certification body, customer reviewer, or other authorized evaluator determines its own scope, procedures, evidence sufficiency, reliance, and conclusion.
Interactive experiences
Use the tools as a starting point.
Interactive experiences such as What Applies?, Can You Prove It?, diagnostics, scorecards, and similar tools may generate directional, preliminary, or synthetic outputs based on the information provided and the logic in use at that time. A website output should not be treated as a final legal, compliance, audit, security, financial, HR, or regulatory determination.
You are responsible for reviewing outputs, supplying accurate information, involving the appropriate accountable owners, and deciding what action to take.
Your submissions
Only submit information you are authorized to provide.
Public forms are for scoping
Do not submit passwords, production credentials, protected health information, Social Security numbers, detailed financial-account information, sensitive employee records, or other confidential client data through a public website form unless we expressly provide an approved secure intake for that purpose.
Your responsibility
You represent that you have the right to provide information you submit and that your submission does not violate law, confidentiality obligations, intellectual-property rights, or the rights of another person or organization.
Acceptable use
Do not use the site to interfere with the site or misuse Pulse materials.
You may not use the website to violate law; attempt unauthorized access; interfere with security or availability; introduce malicious code; impersonate another person; collect information through abusive automated means; bypass access restrictions; or use the site in a way that materially burdens or disrupts its operation.
You may review public Pulse materials for legitimate business evaluation. You may not copy, reproduce, distribute, modify, reverse engineer, decompile, extract proprietary logic from, or create derivative commercial products from protected Pulse software, methods, source code, private artifacts, or nonpublic materials except where a separate written agreement or applicable law expressly permits it.
Intellectual property
The website does not transfer ownership of Pulse technology, methods, or brands.
The website and its original text, graphics, methods, designs, software, reports, interactive experiences, and other materials are owned by or licensed to the applicable Pulse or Fierce entity and are protected by applicable intellectual-property laws. Pulse Governance, Execution Integrity, Execution Integrity Infrastructure, The Closure Method, related marks, and related patent-pending or proprietary technology remain the property of their respective owners.
Any limited permission to access public content is personal, revocable, nonexclusive, and does not grant ownership, source-code rights, patent rights, trademark rights, or a license to use nonpublic Pulse methods or technology.
Third-party services
External links and embeds are governed by their providers.
The website may link to or use third-party services such as scheduling, CRM forms, analytics, videos, professional resources, or external websites. Pulse does not control the availability, content, security, or terms of third-party services. A link or integration does not, by itself, constitute an endorsement.
Availability and changes
The public website can change as Pulse changes.
We may update, suspend, remove, or change website content, features, offers, or availability. Product capabilities, delivery timing, pricing, framework coverage, and professional deliverables are determined by the current scope and applicable written agreement, not by an older website statement or demonstration.
Disclaimers and liability
The website is provided on an “as available” basis.
To the maximum extent permitted by law, the public website and public informational materials are provided without warranties of uninterrupted availability, error-free operation, fitness for a particular purpose, noninfringement, or a guaranteed business, regulatory, audit, certification, security, or compliance outcome.
To the maximum extent permitted by law, Pulse and the applicable Fierce entities will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of or inability to use the public website. Nothing in these terms excludes liability that cannot lawfully be excluded or limited.
Disputes, updates, and contact
Separate engagement terms remain separate.
These website terms do not replace the governing-law, dispute-resolution, confidentiality, indemnity, limitation, or other provisions of a signed engagement or commercial agreement. Any dispute relating to a contracted service is governed by the applicable written agreement.
We may update these website terms as the site and services evolve. The revised terms apply to website use after the updated effective date is posted.
